Terms of Service

Please read these Terms of Service (“Terms”) carefully before using launchkbeauty.com (the “Site”). By accessing or using any part of the Site, you agree to be bound by these Terms. If you do not agree to all terms, you may not access or use the Site.

These Terms are entered into between you and Launch K-Beauty, operated by Opepe, Republic of Korea (“we,” “our,” or “us”).

1. Description of Services

Launch K-Beauty provides:

  • SaaS Platform: A subscription-based platform that provides AI-powered manufacturer matching, automated RFQ (Request for Quotation) generation, compliance checklists, and a brand launch pipeline dashboard. Access is provided through tiered subscription plans (Explore, Insider, Partner, Concierge).
  • AI-Powered Matching: Our platform uses algorithmic and AI-assisted matching to connect you with Korean cosmetics manufacturers based on your Brand Brief. Matching results are recommendations only and do not constitute endorsements, guarantees of quality, or assurances of business outcomes.
  • RFQ Services: Automated generation and delivery of Request for Quotation documents to manufacturers on your behalf. RFQ delivery does not guarantee a manufacturer response, and we are not a party to any agreement between you and a manufacturer.
  • Manufacturer Directory: A searchable directory of Korean cosmetics manufacturers, OEM/ODM suppliers, and related businesses. Free-tier users see limited (blurred) directory data; full access requires a paid subscription.
  • Digital Products: Downloadable PDF guides (currently the K-Beauty Brand Launch Guide) sold via Paddle checkout or included with certain subscription tiers.
  • Premium Directory Subscriptions: Enhanced manufacturer profiles with analytics and tools, sold via Paddle.

1A. SaaS Subscription Terms

1A.1 Subscription Plans

We offer tiered subscription plans with varying features, matching quotas, and service levels. Current plans, pricing, and included features are described on our Pricing page. We reserve the right to modify plan features and pricing with 30 days’ notice.

1A.2 Free Trial

Certain subscription plans include a 7-day free trial. During the trial, you have full access to the plan’s features. If you do not cancel before the trial ends, your payment method will be charged the applicable subscription fee. You may cancel the trial at any time during the 7-day period at no cost.

1A.3 Billing and Renewal

Subscriptions are billed monthly in advance via Paddle. Your subscription automatically renews at the end of each billing period unless you cancel. Paddle is the merchant of record and handles all payment processing, invoicing, and tax collection.

1A.4 Cancellation

You may cancel your subscription at any time from your dashboard or by contacting support@launchkbeauty.com. Cancellation takes effect at the end of your current billing period. You retain access to paid features until the end of the period. No partial refunds are issued for unused time within a billing period.

1A.5 Matching Quotas

Each subscription tier includes a monthly quota for AI-powered manufacturer matches. Unused quota does not roll over to subsequent months. Quota resets on your billing renewal date.

1B. AI Matching Disclaimer

Our AI-powered matching service provides algorithmically generated recommendations based on the information you provide in your Brand Brief and publicly available manufacturer data. You acknowledge and agree that:

  • Matching results are recommendations only and do not constitute professional advice, endorsements, or guarantees
  • We do not guarantee the accuracy, completeness, or suitability of any matching result for your specific needs
  • You are responsible for independently verifying manufacturer credentials, certifications, and capabilities before entering into any business relationship
  • AI matching quality depends on the accuracy and completeness of the information you provide in your Brand Brief
  • We are not a party to, and accept no liability for, any transaction or agreement between you and a matched manufacturer

1C. RFQ Service Terms

When you use our RFQ generation and delivery service, you acknowledge that:

  • RFQ documents are generated based on your Brand Brief and matching data, and you are responsible for reviewing them before sending
  • We deliver RFQs to manufacturers on your behalf via email but cannot guarantee delivery, receipt, or response
  • Any quotes, pricing, or terms provided by manufacturers in response to RFQs are between you and the manufacturer — we are not a party to those negotiations
  • RFQ communication data (including manufacturer responses) may be stored and used to improve our matching algorithms and service quality

1D. Data Processing for Matching

To provide AI-powered matching and RFQ services, we process the following data:

  • Brand Brief data: Product categories, target markets, budget, certifications needed, timeline, and other preferences you submit
  • Matching interaction data: Which matches you view, save, or send RFQs to — used to improve matching quality
  • RFQ communication data: RFQ documents sent and manufacturer responses received, including quoted pricing, MOQs, and lead times

This data is processed under our Privacy Policy. We may use aggregated and anonymized data to improve our matching algorithms and platform features.

2. Eligibility

You must be at least 18 years of age to use this Site or purchase any products or services. By using the Site, you represent that you are 18 or older and have the legal capacity to enter into a binding agreement. Use on behalf of a company or organization requires that you have authority to bind that entity.

3. User Accounts

Some features (such as claiming a listing or accessing premium content) may require you to create an account using Google or email authentication. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activity that occurs under your account
  • Notifying us immediately at support@launchkbeauty.com if you suspect unauthorized access

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Directory Listings

4.1 For Visitors Using the Directory

The directory is provided for informational purposes. We make reasonable efforts to ensure accuracy but do not guarantee that any listing is complete, current, or free from errors. See our Disclaimer for full details.

4.2 For Manufacturers Claiming or Submitting Listings

By claiming or submitting a listing, you represent that you are authorized to act on behalf of the business and that the information you provide is accurate and not misleading. You agree to:

  • Provide truthful and accurate business information
  • Not include false certifications, misleading claims, or intellectual property that you do not own
  • Keep your listing information current — notify us of material changes
  • Not use the listing for illegal or fraudulent purposes

We reserve the right to remove, edit, or refuse any listing at our sole discretion, including for inaccurate information, user complaints, or violations of these Terms.

5. Digital Products (PDF Guides)

5.1 License

Upon purchase of a digital product through Paddle, we grant you a personal, non-transferable, non-exclusive license to access and use the content for your own business planning purposes. You may not:

  • Redistribute, resell, or sublicense the content
  • Share download links with third parties
  • Remove copyright notices or attribution
  • Use the content to create competing products without our written consent

5.2 Delivery

Digital products are delivered electronically via Paddle immediately upon payment confirmation. Delivery issues should be reported to support@launchkbeauty.com within 7 days of purchase. See our Refund Policy for applicable refund terms.

6. Concierge and Premium Services

6.1 Scope of Service

Concierge-tier subscribers and custom engagement clients may receive platform tools including manufacturer matching, RFQ automation, compliance tracking, and factory verification reports. The scope and deliverables for Concierge engagements are agreed in writing prior to commencement.

6.2 Not Professional Legal, Financial, or Regulatory Advice

Our platform services provide business guidance and manufacturer connections based on practical experience in the K-beauty industry. They do not constitute legal advice, financial advice, regulatory compliance advice, or medical claims review. You are responsible for independently verifying compliance requirements for your specific markets and obtaining appropriate professional advice.

6.3 Cancellation and Rescheduling

Subscription cancellations take effect at the end of the current billing period. One-time digital product purchases are subject to our refund terms. See our Refund Policy for full details.

6.4 Client Responsibilities

You agree to provide accurate information about your project and goals in your Brand Brief, respond to reasonable requests for information in a timely manner, and use deliverables lawfully and in accordance with these Terms.

7. Payments

Payments are processed through the following platforms acting as merchant of record or seller of record:

  • Paddle — for all paid transactions including digital products, platform subscriptions, and digital products. Paddle is the merchant of record and handles all payment processing, VAT/sales tax collection, invoicing, and refunds globally. Their Terms and Privacy Policy govern payment processing.

All prices are displayed in USD. You are responsible for any applicable taxes not handled by our payment processors.

8. Intellectual Property

All content on the Site — including text, graphics, logos, guides, photographs, and software — is owned by Launch K-Beauty or licensed to us, and is protected by applicable copyright, trademark, and intellectual property laws.

You may not:

  • Copy, scrape, or systematically extract content from the directory without our written permission
  • Use our name, logo, or branding without our written consent
  • Frame the Site or use our content in a manner that suggests affiliation without authorization

Manufacturers who submit listing information retain ownership of their own business information. By submitting it, you grant us a non-exclusive, worldwide license to publish and display that information on the Site.

9. Prohibited Uses

You agree not to use the Site to:

  • Violate any applicable local, national, or international law
  • Transmit unsolicited commercial communications (spam) to other users or listed manufacturers
  • Submit false, inaccurate, or misleading listing information or reviews
  • Attempt to gain unauthorized access to any part of the Site or its infrastructure
  • Use automated means to scrape, crawl, or harvest data from the Site
  • Interfere with or disrupt the integrity or performance of the Site
  • Impersonate any person or entity or misrepresent your affiliation

10. Disclaimer of Warranties

THE SITE AND ALL SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted or error-free, that directory information is complete or current, or that any manufacturer connection will result in a successful business relationship.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LAUNCH K-BEAUTY AND ITS OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, BUSINESS OPPORTUNITIES, OR GOODWILL — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE, DIRECTORY LISTINGS, DIGITAL PRODUCTS, OR PLATFORM SERVICES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $100.

Some jurisdictions do not allow limitations on implied warranties or exclusion of incidental damages. If these restrictions apply to you, some of the above limitations may not apply.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Korea, without regard to conflict of law principles.

For users in the EU/EEA: Nothing in these Terms affects your statutory rights as a consumer under EU law, including rights under the Consumer Rights Directive and applicable national consumer protection laws.

For disputes: We encourage you to contact us first at support@launchkbeauty.com to resolve issues informally. If informal resolution is not possible, disputes will be subject to the exclusive jurisdiction of courts in Seoul, Republic of Korea, except where mandatory consumer protection law in your country requires local jurisdiction.

13. Changes to These Terms

We may update these Terms periodically. We will notify you of material changes by updating the effective date and, for significant changes, by posting a notice on the Site or sending an email. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
